Right To Information

The mission of Birbhum District Police is to enforce the law and to bring the attitudinal change for greater police public harmony and thereby achieve greater efficiency in its primary objective of prevention of crime and detection of crime. Police must be compassionate, courteous and patient, acting without fear or favour or prejudice to rights of others.

 

Right To information includes the rights

.1. Inspect works, documents, and records.

2.Take notes, extracts or certified copies of documents or records.

3.Take certified samples of material.

4.Obtain information in form of printouts, diskettes, floppies, tapes, video ,cassettes or in any other electronic mode or through printouts

"Information" means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples,models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force.

Record Includes

1.Any document, manuscript and file

2.Any microfilm, microfiche, and facsimile copy of a document.

3.Any reproduction of image or images embodied in such microfilm (whether enlarged or not);

4.Any other material produced by a computer or any other device;

An applicant cannot ask for opinions/advice/views under the RTI Act, unless the opinion/advice/view is already on "record".However, under Section 4(1)(d), an applicant can ask for "reasons" behind a administrative or quasi judicial decision of a public authority, especially if he is a "affected person".


Right to information and Obligations of Public Authorities  

1 .Obligations of Public Authorities :- (1) Every public authority shall –

  1. Maintain all its records duly catalogued and indexed in a manner and the form which facilitates the right to information under this Act and ensure that all records that are appropriate to be computerized are, within a reasonable time and subject to availability of resources, computerized and connected  through a network all over the country on different systems so that access to such records is facilitated.
  2. Public within one hundred and twenty days from the enactment of this Act, ---
  3. The particulars of its organization, function and duties;
  4. The powers and duties of its officers and employees;
  5. The procedure followed in the decision making process, including channels of supervision and accountability;
  6. The norms set by it for discharge of its functions;
  7. The rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions;
  8. A statement of the categories of documents that are held by it or under its control;
  9. The particulars of any arrangement that exists for consultation with, or representation by, the members of the public in relation to the formulation of its policy or implementation thereof;
  10.  A statement of this boards. Councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advise, and as to whether  meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public;
  11. A directory of its officers and employees;
  12. The monthly remuneration received b each of its officers and employees, including the system of compensation as provided in its regulations;
  13. The budget allocated to each of its agency, indicating the particulars of all plans, proposed expenditures and reports on disbursements made;
  14. The manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes;
  15. Particulars of recipients of concessions, permits or authorizations granted by it;
  16. Details in respect of the information, available to or held by it, reduced in an electronic form;
  17. The particulars of facilities available to citizens for obtaining information, including the working hours of a library or reading room, if maintained for public use;
  18. The names, designations and other particulars of the Public Information Officers;
  19. Such other information as may be prescribed; and thereafter update these publications every year;
  20. Publish all relevant facts while formulating important policies or announcing the decisions which affect public;
  21. Provide reasons for its administrative or quasi-judicial decisions to affected persons;

Designated Officers 

  Any citizen can ask for information under these laws.The Act extends to the whole of India except the State of Jammu and Kashmir. OCI's (Overseas Citizens of India) and PIO's (Persons of Indian Origin) card holders can also ask for information under the RTI Act.For citizens, OCI's and PIO's who are staying out of India, the RTI Application can be filed with the PIO of the local Indian Embassy/Consulate/High Commission They will inform you regarding the amount of application fee in local currency as well as the mode of payment.
